These Terms of Service ("Terms") govern your access to and use of the FlopMetric website, applications, and related services (collectively, the "Service").

By accessing or using FlopMetric, you agree to these Terms. If you do not agree, do not use the Service.

1. About FlopMetric

FlopMetric is a post-session poker analytics service that allows users to upload supported hand-history files and review statistics, results, hand histories, starting-hand performance, equity-related information, and other analysis generated from those files.

FlopMetric is intended for personal analysis and review after gameplay.

FlopMetric is not a poker operator, gambling platform, casino, sportsbook, or real-money gaming service.

2. Eligibility

You may use FlopMetric only if:

  • You are legally permitted to use the Service in your jurisdiction.
  • You are legally permitted to engage with poker-related content in your jurisdiction.
  • You are capable of entering into a binding agreement under applicable law.

FlopMetric is not intended for children.

3. Account and Authentication

FlopMetric currently uses Google authentication for account access.

You are responsible for:

  • Maintaining the security of your Google account and devices
  • Keeping your login session secure
  • Ensuring that activity performed through your account is authorized by you
  • Contacting us promptly if you believe your account has been compromised

FlopMetric may suspend or restrict access where reasonably necessary to protect the Service, other users, or system security.

4. Private Beta and Service Availability

FlopMetric may operate in private beta, public beta, preview, experimental, or limited-access modes.

During beta periods:

  • Features may change without notice
  • Data models, statistics, calculations, or interfaces may be modified
  • Certain features may be incomplete or temporarily unavailable
  • Access may be limited to invited users
  • Stored data may need to be migrated, recalculated, or removed in exceptional cases

We do not guarantee uninterrupted availability during beta operation.

5. User-Uploaded Hand Histories

You may upload supported poker hand-history files to FlopMetric for personal post-session analysis.

You represent and warrant that:

  • You are authorized to possess and use the files you upload
  • Your upload does not violate applicable law
  • Your use of the uploaded data does not violate the terms or rules of the relevant poker platform
  • You will not upload data obtained through unauthorized access, scraping, interception, or prohibited real-time collection

You retain responsibility for the files and information you choose to upload.

6. Permitted Use

You may use FlopMetric for legitimate personal poker analysis, including:

  • Reviewing your own historical play
  • Tracking performance
  • Reviewing hand histories
  • Reviewing starting-hand performance
  • Reviewing positional statistics
  • Reviewing all-in equity or EV-related information
  • Tagging hands for later review
  • Exporting or viewing analysis generated from your own uploaded data

7. Prohibited Use

You may not use FlopMetric to:

  • Obtain or display real-time gameplay information
  • Use FlopMetric as a HUD or real-time overlay
  • Receive real-time decision support during active poker play
  • Automate gameplay or betting decisions
  • Interact with, control, inspect, or interfere with a poker client
  • Import or process gameplay data in real time
  • Build or distribute shared opponent databases
  • Aggregate player-pool information for use by multiple users
  • Profile opponents across accounts for real-time or competitive advantage
  • Scrape, intercept, or acquire data without authorization
  • Bypass technical restrictions or access controls
  • Reverse engineer or attempt to extract non-public source code, except where permitted by applicable law
  • Use the Service for fraud, abuse, unlawful conduct, or violation of third-party rights

8. Post-Session Use Requirement

FlopMetric is designed for post-session analysis.

Users are responsible for complying with the rules and terms of the poker platforms they use.

For CoinPoker-related hand histories, users should not use FlopMetric while the CoinPoker client is open or during active gameplay where such use would violate CoinPoker rules or restrictions.

FlopMetric does not guarantee that use of the Service is permitted by every poker operator in every situation. Users are responsible for reviewing and complying with the applicable platform rules.

9. Accuracy of Analytics

FlopMetric attempts to provide accurate parsing, calculations, and analytics based on supported hand-history formats.

However:

  • Hand-history formats may change
  • Some formats may be unsupported
  • Some hands may be excluded
  • Certain calculations may rely on assumptions or available data
  • Errors, parsing differences, rounding, or calculation limitations may occur

FlopMetric does not guarantee that every statistic, equity value, EV calculation, result, or analysis is complete or error-free.

Users should independently verify information where accuracy is important.

10. No Professional Advice

FlopMetric provides analytical and informational tools only.

Nothing provided by FlopMetric constitutes:

  • Gambling advice
  • Financial advice
  • Investment advice
  • Legal advice
  • Tax advice
  • Professional coaching
  • A guarantee of future poker performance or winnings

Poker involves variance, risk, and potential financial loss.

Users remain solely responsible for their own decisions and gameplay.

11. User Data and Privacy

Your use of FlopMetric is also governed by our Privacy Policy.

The Privacy Policy explains how we collect, use, store, and delete account information, uploaded hand-history data, analysis data, and technical information.

12. Intellectual Property

FlopMetric and its original software, branding, interface designs, text, graphics, analytics presentation, and related materials are owned by or licensed to FlopMetric and are protected by applicable intellectual-property laws.

These Terms do not transfer ownership of FlopMetric intellectual property to you.

You may not copy, reproduce, distribute, sell, license, or commercially exploit substantial portions of FlopMetric without permission, except where applicable law permits otherwise.

Poker hand histories and third-party names, trademarks, and content remain subject to the rights of their respective owners.

13. Third-Party Services and Trademarks

FlopMetric may integrate with or rely on third-party services such as Google, Supabase, and Vercel.

Your use of those third-party services may also be subject to their own terms and policies.

FlopMetric is an independent service unless expressly stated otherwise.

References to third-party poker platforms, including CoinPoker, are for identification and compatibility purposes only.

FlopMetric is not affiliated with, endorsed by, sponsored by, or officially associated with CoinPoker or any other poker operator unless expressly stated.

All third-party trademarks remain the property of their respective owners.

14. Changes to Supported Formats and Features

FlopMetric may add, change, restrict, or discontinue support for:

  • Poker platforms
  • Hand-history formats
  • Game types
  • Analytics
  • Filters
  • Statistics
  • Exports
  • Review tools
  • Other features

We may make such changes where necessary for technical, legal, operational, security, or product reasons.

15. Suspension and Termination

We may suspend, restrict, or terminate access to FlopMetric if we reasonably believe that a user:

  • Violated these Terms
  • Used the Service for prohibited real-time assistance
  • Attempted unauthorized access
  • Abused the Service
  • Threatened system security
  • Violated applicable law
  • Created material risk for FlopMetric or other users

Where appropriate, we may provide notice or an opportunity to resolve the issue.

Users may stop using the Service at any time.

16. Service Changes and Discontinuation

We may modify, suspend, or discontinue all or part of FlopMetric.

Where reasonably practical, we may provide notice of material changes or discontinuation.

We are not obligated to maintain any specific feature, format, statistic, or service indefinitely.

17. Disclaimer of Warranties

To the maximum extent permitted by applicable law, FlopMetric is provided on an "as is" and "as available" basis.

We do not make warranties that:

  • The Service will always be available
  • The Service will be free of errors
  • All hand histories will parse correctly
  • All calculations will be accurate
  • The Service will meet every user's requirements
  • Use of the Service will improve poker performance
  • Use of the Service will produce profits or winnings

Nothing in these Terms excludes rights that cannot lawfully be excluded.

18. Limitation of Liability

To the maximum extent permitted by applicable law, FlopMetric will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to use of the Service.

This includes, without limitation, losses relating to:

  • Poker results
  • Gambling losses
  • Lost profits
  • Loss of data
  • Service interruption
  • Reliance on analytics
  • Account restrictions imposed by third-party poker operators
  • Third-party services

Where liability cannot legally be excluded, it will be limited to the extent permitted by applicable law.

19. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses, claims, liabilities, or expenses resulting from your misuse of FlopMetric, violation of these Terms, violation of applicable law, or infringement of third-party rights.

20. Changes to These Terms

We may update these Terms as FlopMetric develops or as legal, technical, or operational requirements change.

When material changes are made, we may provide notice through the Service or by other reasonable means.

The "Last Updated" date at the top indicates the most recent revision.

Continued use of the Service after revised Terms become effective may constitute acceptance of the updated Terms where permitted by applicable law.
